Terms of Service
Effective October 20, 2026
These Terms of Service ("Terms") are a binding agreement between you and FieldKrow LLC, an Arizona limited liability company ("FieldKrow," "we," "us"). They govern your use of fieldkrow.com, the FieldKrow app at app.fieldkrow.com and any FieldKrow mobile app, the booking, customer, payment and review pages we host for businesses, our texting, calling and voicemail features, the FieldKrow v1 template, and our support (together, the "Service").
Please read Section 21. It requires most disputes to be resolved by individual binding arbitration, waives class actions and jury trials, and limits the time you have to bring a claim.
By creating an account, clicking to accept, or using the Service, you agree to these Terms, our Acceptable Use Policy, our SMS Program Terms and our Privacy Policy, each of which is part of these Terms. If you use the Service for a business, "you" means that business and you confirm you have authority to bind it. If you do not agree, do not use the Service.
1. Business use only
The Service is a business tool. You may use it only for a trade, business or profession, and not for personal, family or household purposes. You must be at least 18 years old.
2. What FieldKrow is, and what it is not
FieldKrow is software that helps home-service businesses take bookings, organize jobs and crews, text and call their own customers, send estimates, invoices and payment links, and ask for reviews. FieldKrow provides software only.
- We are not a party to your jobs. We do not perform, supervise, schedule, price, inspect or guarantee any service, and we are not a party to any agreement between you and your customers, crew, subcontractors or vendors.
- We are not your employer, agent, broker, payment processor, bank, money transmitter, telephone carrier, insurer, lawyer, accountant or tax adviser.
- You alone are responsible for your business, including the quality and safety of your work; property damage, personal injury and death; licenses, permits, registrations and insurance; disposal, recycling, dumping and environmental rules; vehicle and traffic safety; pricing, estimates, refunds and warranties you give; hiring, supervising, classifying and paying workers (including any tips owed to them); and all taxes.
- Information in the Service is a tool, not advice. Routes, drive times, maps, addresses, reminders, dashboards, AI suggestions and templates may be incomplete or wrong. Check them yourself. Never use the Service while driving in a way that breaks the law or distracts you.
3. Accounts and users
- Give us accurate, current business and contact information and keep it up to date.
- You are responsible for everything done under your account, including by people you invite, and for choosing their roles and access. Keep sign-in details secure and tell us at once at [email protected] if you suspect unauthorized access.
- Your plan sets how many users, brands and other resources you can use. One account per business unless we agree otherwise in writing.
4. Plans, fees and billing
- Prices and limits. Plan prices, included users, brands, texts, call minutes, jobs, emails and storage, add-ons and any platform fee are those shown on our Pricing page when you subscribe, or in a written quote from us. Prices are in U.S. dollars and exclude taxes, which you pay.
- Automatic renewal. Paid plans and add-ons are billed in advance and renew automatically for the same period (monthly or yearly) until cancelled. By subscribing you authorize us and our billing processor to charge your payment method for each renewal.
- Founding offer. If you receive founding pricing, it applies for 12 months from the start of your paid subscription, then the list price applies. It ends early if you cancel or change plans, and cannot be transferred.
- Limits. When you reach a monthly limit, the affected feature (for example, sending texts or creating jobs) pauses until your next billing period unless you buy an add-on or change plans. We are not responsible for messages, jobs or calls that do not happen because a limit was reached.
- Platform fee. On the Free plan, a platform fee shown on the Pricing page applies to card payments processed through FieldKrow, in addition to the payment processor's own fees.
- Changes to plans. Plan changes take effect from your next billing date unless we tell you otherwise. If you move to a plan with lower limits, features and data above the new limits may become unavailable.
- Cancellation and refunds. You can cancel at any time by emailing [email protected] from your account email (or in the app, where available). Cancellation takes effect at the end of the period you have paid for, and you keep access until then. All fees are non-refundable, including for partial periods, unused allowances and yearly plans, except where the law requires otherwise.
- Failed payments. If a payment fails, we will email you. If it is not fixed within 14 days, paid features pause until it is paid.
- Price changes. We will email you at least 30 days before a price change to your plan takes effect. If you do not cancel before then, the new price applies.
- Trials and demos. Any free trial or demo is provided as-is, may have limited features, and may end or be deleted at any time. Demo accounts use sample data only and are deleted when they expire.
5. Features in development
Features marked "coming soon," "beta," "preview" or "test" are not yet available or are provided as-is for evaluation. We may change, delay or never release any feature. You agree that you are not relying on any future feature, or on any statement about one, in deciding to use or pay for the Service.
6. Texting, calling and voicemail
You are the sender of every text and the caller on every call made through your account, whether you send it by hand or set it to send automatically. FieldKrow only transmits it on your instructions. You agree that:
- Consent. You will text and call only people who have given your business the consent the law requires (including prior express written consent where required), you will keep records of that consent for at least five years, and you will provide those records to us on request.
- Opt-outs. You will honor every opt-out right away. FieldKrow stops texts to numbers that reply with standard opt-out keywords, but you are responsible for opt-outs given any other way.
- The law. You will comply with the Telephone Consumer Protection Act, the Telemarketing Sales Rule, CAN-SPAM, state telemarketing, texting and quiet-hours laws, wireless carrier rules and the CTIA Messaging Principles and Best Practices.
- Recording and transcription. If your account records calls or voicemails, or transcribes them, you are solely responsible for giving any notices and getting any consents the law requires, including in states that require every party to agree.
- Registration. You authorize us to submit carrier registrations (such as A2P 10DLC or toll-free verification) for your business using the information you give us. You confirm that information is true and complete and will keep it current. Registrations are decided by carriers and their partners; we do not guarantee approval or timing.
- Content and templates. You are responsible for the content of your messages, including templates and automations you turn on and the job details (names, dates, times, amounts, addresses) they draw from. Review them before you use them.
- No emergency calls. The Service cannot be used to call 911 or other emergency services. Keep another way to call for help.
- Delivery. Carriers and providers may filter, delay, block or drop messages and calls. We do not guarantee delivery, timing or transcription accuracy, and we are not liable for messages or calls that are delayed, not delivered, sent more than once or sent to the wrong person because of information in your account.
- We may pause texting or calling on any account that draws complaints, breaks these rules, or puts other accounts' delivery at risk.
7. Payments from your customers
- Card payments are processed by Stripe through your own Stripe account. To accept them you must agree to Stripe's terms, including the Stripe Connected Account Agreement. Stripe, not FieldKrow, holds and moves the funds. FieldKrow never holds your money.
- Payments you record by hand (cash, check or another app) are your own records; we do not verify them.
- You are responsible for the amounts you charge, receipts, refunds, chargebacks, disputes, fraud losses, processor fees, sales and income taxes, and the lawful handling and distribution of tips.
8. AI features
Some features use artificial intelligence to suggest, summarize, transcribe or draft content. AI output can be wrong or incomplete and is not advice. You are responsible for reviewing it before you rely on or send it, and for any disclosures the law requires when AI is used with your customers.
9. Your data and your customers' data
- You own the information you and your customers put into the Service ("Account Data"). You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit and display Account Data to provide, secure, support and improve the Service and as required by law.
- You are responsible for your Account Data and for having every right, notice and consent the law requires to collect it and to let us process it, including your customers' information, photos and recordings. For your customers' information, you decide what is collected and how it is used, and we process it on your behalf.
- We may use data that has been aggregated and de-identified so it does not identify you or any person to operate and improve the Service.
- Keep your own copies of anything important. While your account is active and for 30 days after it closes, you can ask [email protected] for an export of your Account Data. After that we may delete it, except as our Privacy Policy says. We are not responsible for lost or damaged data, including because of an outage, a third-party service or your instructions.
10. Acceptable use
You will follow our Acceptable Use Policy. You will not copy, resell, reverse engineer or interfere with the Service, or use it to build a competing product.
11. Third-party services
The Service relies on and connects to services we do not control, including Supabase, Vercel, Twilio, Stripe, Google, Resend, Cloudflare, Anthropic, Apple and WordPress, and to your own website. Their terms govern your use of them. We are not responsible for their availability, security, actions, fees or changes, and an outage or change at one of them may affect the Service.
12. Availability, support and changes
- We may change, suspend or discontinue any part of the Service. We do not promise that the Service will be available, uninterrupted, timely, secure or error-free, and there is no service-level commitment unless we sign one with you in writing.
- Support is provided by email and in-app messages. 1-888-602-KROW takes voicemail only; it is not answered live. We do not promise a response time.
- We may update these Terms. If a change is material, we will email account owners at least 30 days before it takes effect. Using the Service after that date means you accept the change.
13. FieldKrow v1
FieldKrow v1 is a legacy template that runs in your own Google account. It is free, unsupported, and provided as-is with no warranty and no updates. Google bills you for AppSheet. You are solely responsible for your copy, its data, any Twilio or other account you connect to it and the messages it sends. FieldKrow has no access to, and no liability for, your v1 copy.
14. Intellectual property and feedback
We and our licensors own the Service, including its software, design, templates and content, apart from your Account Data. We grant you a limited, revocable, non-transferable right to use the Service under these Terms during your subscription. If you send us ideas or feedback, we may use them without obligation to you.
15. Suspension and termination
You may stop using the Service at any time. We may suspend or end your account, or any feature, at any time if we believe you have broken these Terms or the law, have not paid, have put FieldKrow, other customers, carriers or the public at risk, or if a carrier, payment processor or the law requires it. Sections 2, 4 (fees owed and refunds), 6 to 9, and 13 to 24 survive termination.
16. Disclaimer of warranties
THE SERVICE, FIELDKROW v1, AND ALL CONTENT, AI OUTPUT, ROUTES, TEMPLATES, DEMOS AND SUPPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. TO THE FULLEST EXTENT THE LAW ALLOWS, FIELDKROW AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS AND LICENSORS (THE "FIELDKROW PARTIES") DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT AND ANY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR NEEDS, THAT MESSAGES, CALLS, PAYMENTS OR BOOKINGS WILL BE DELIVERED OR RECORDED, THAT DATA WILL NOT BE LOST, OR THAT THE SERVICE WILL INCREASE YOUR BOOKINGS, REVIEWS OR REVENUE.
FREE ACCOUNTS HAVE NO SERVICE LEVEL, NO SUPPORT COMMITMENT, NO BACKUP OR RESTORE COMMITMENT AND NO GUARANTEE THAT DATA OR FEATURES WILL BE KEPT, AND WE MAY LIMIT, CHANGE OR END THEM AT ANY TIME.
17. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- THE FIELDKROW PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, BOOKINGS, CUSTOMERS, GOODWILL OR DATA, OR THE COST OF SUBSTITUTE SERVICES, HOWEVER CAUSED AND UNDER ANY THEORY (CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, STATUTE OR OTHERWISE), EVEN IF ADVISED OF THEIR POSSIBILITY.
- THE FIELDKROW PARTIES WILL NOT BE LIABLE FOR ANY CLAIM ARISING FROM YOUR SERVICES OR WORK, YOUR CREW OR CONTRACTORS, YOUR CUSTOMERS, YOUR MESSAGES OR CALLS, YOUR PAYMENTS, OR ANY THIRD-PARTY SERVICE.
- THE FIELDKROW PARTIES' TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID FIELDKROW IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE FIRST CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
THE FREE PLAN, FREE TRIALS AND DEMOS ARE PROVIDED AT NO CHARGE. FOR THEM, AND FOR ANY CLAIM WHERE YOU PAID NOTHING IN THE THREE MONTHS BEFORE THE EVENT, THE CAP IN (B) IS $100 AND NOTHING MORE. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FIELDKROW'S OWN GROSS NEGLIGENCE, WILLFUL MISCONDUCT OR FRAUD, OR ANY LIABILITY THE LAW DOES NOT ALLOW TO BE LIMITED OR WAIVED. IN THOSE CASES, AND ONLY TO THAT EXTENT, THE LIMITS ABOVE DO NOT APPLY.
These limits are an essential part of the bargain between us, apply even if a remedy fails of its essential purpose, and apply to the FieldKrow Parties collectively. Some jurisdictions do not allow certain exclusions; in those places the exclusions apply to the greatest extent allowed.
18. Indemnity
You will defend, indemnify and hold harmless the FieldKrow Parties from and against all claims, demands, investigations, fines, penalties, losses, damages, judgments, settlements, costs and expenses (including reasonable attorneys' and experts' fees) arising out of or relating to: (a) your business, services and work, including any property damage, injury or death; (b) your crew, employees, contractors and users, including wage, tip, classification and employment claims; (c) your texts, calls, recordings, transcriptions and other communications, including claims under the TCPA, state telemarketing and texting laws, and recording laws; (d) your payments, refunds, chargebacks, disputes and taxes; (e) your Account Data and your collection and use of personal information; (f) your website, booking forms and content; (g) any claim by your customers or other third parties relating to your use of the Service; and (h) your breach of these Terms or of any law. We may choose our own counsel at your expense and control the defense of any claim. You may not settle a claim that involves us without our written consent. Your indemnity does not cover a claim to the extent a court or arbitrator finally decides it was caused by FieldKrow's gross negligence or willful misconduct.
19. Release
Disputes between you and your customers, crew or any other third party are yours alone. To the fullest extent the law allows, you release the FieldKrow Parties from all claims and damages of every kind arising out of or connected with those disputes. This release does not apply to FieldKrow's gross negligence, willful misconduct or fraud.
20. Time to bring a claim
Any claim relating to the Service or these Terms must be brought within one year after it arises, or it is permanently barred, to the extent the law allows.
21. Dispute resolution: arbitration, class action and jury waiver
- Talk to us first. Before starting any proceeding, send a written description of the dispute to [email protected] and to our mailing address below. We will try to resolve it informally for 30 days.
- Binding arbitration. Any dispute, claim or controversy relating to the Service or these Terms, including whether this section applies, will be resolved by confidential, binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before one arbitrator, in Maricopa County, Arizona (or by video, if both sides agree). Judgment on the award may be entered in any court with jurisdiction.
- Exceptions. Either side may bring an individual claim in small-claims court, and either side may ask a court for an injunction to protect its intellectual property or to stop misuse of the Service.
- No class actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine claims of more than one party.
- Jury waiver. If any dispute goes to court for any reason, both sides waive any right to a jury trial.
- If the class action waiver is found unenforceable for a claim, that claim will be decided in court and not in arbitration.
22. Governing law and venue
Arizona law governs these Terms, without regard to conflict-of-law rules, and the Federal Arbitration Act governs Section 21. Subject to Section 21, the state and federal courts in Maricopa County, Arizona have exclusive jurisdiction, and you consent to them.
23. General
- These Terms and the policies they refer to are the entire agreement about the Service and replace any earlier statements, including marketing materials. If a written order signed by both of us conflicts with these Terms, the order controls for that conflict only.
- You may not assign these Terms without our written consent. We may assign them, including in a merger or sale of our business.
- We are not liable for delays or failures caused by events beyond our reasonable control, including outages of carriers, cloud or payment providers, internet failures, natural disasters, labor disputes, government action and cyberattacks.
- If any part of these Terms is unenforceable, it will be enforced to the maximum extent allowed and the rest stays in effect. Our not enforcing a term is not a waiver.
- We are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, fiduciary or employment relationship.
- You agree to receive notices and agreements electronically. We send notices to your account email; you send notices to [email protected].
